These General Terms and Conditions (GTC) apply to the use of the online platform Wannja.ch (hereinafter "Platform" or "Service"), operated by:
e-sysBy registering on or using the Platform, the user accepts these GTC.
Wannja.ch is an online platform for creating and managing scheduling polls and event sign-ups. The Platform is offered in different variants:
The exact functions of the individual variants are described on the Pro features page.
3.1. A user account is required to create and manage polls and sign-ups; participation in a poll or sign-up is possible without an account. The user undertakes to provide truthful information.
3.2. The user is responsible for keeping their access data confidential and is liable for all activities under their account.
3.3. The user account is not transferable.
3.4. The operator reserves the right to block or delete accounts in the event of violations of these GTC.
3.5. If a poll or sign-up is created without completing the subsequent account step, the content initially remains inactive and is automatically deleted after 48 hours (see section 9).
4.1. The current prices for the Pro subscription are shown on the Platform. Prices are stated in Swiss francs (CHF). The operator is not liable for VAT pursuant to Art. 10 para. 2 of the Swiss Federal Act on Value Added Tax (VAT Act, MWSTG); no VAT is charged.
4.2. Payment is made via the payment service provider Stripe. The terms of use of Stripe apply additionally.
4.3. The Pro subscription can be taken out on a monthly or annual basis.
4.4. The operator reserves the right to change prices. Existing subscriptions are not affected by price increases until the end of the respective term.
5.1. The Pro subscription is automatically renewed for the selected term (month or year) unless it is cancelled before expiry.
5.2. Cancellation can be made at any time via the account settings or by email to support@wannja.ch.
5.3. After cancellation, the Pro subscription remains active until the end of the paid period. The account is then downgraded to Free status.
5.4. Amounts already paid are not refunded upon cancellation, except in the case of cancellation within 14 days of the initial purchase (right of withdrawal).
6.1. When taking out a Pro subscription for the first time, the user has the right to withdraw from the contract within 14 days without giving reasons.
6.2. The withdrawal must be declared in writing by email to support@wannja.ch.
6.3. In the event of withdrawal, the amount paid will be refunded within 14 days.
The user undertakes:
In the event of violations, the operator reserves the right to delete content and block the account.
8.1. If a user creates a poll or sign-up, they themselves determine which persons they invite and which data they collect from participants. They are therefore the controller of this data under data protection law; the operator processes it on their behalf.
8.2. The user warrants that they are entitled to process the contact data they enter and to contact the persons concerned. They inform the participants about the purpose and scope of the processing.
8.3. The sending of invitations and reminders via the Platform must not be used for advertising or other purposes outside the respective poll or sign-up.
8.4. The user indemnifies the operator against third-party claims arising from a breach of sections 8.1 to 8.3.
9.1. Polls and sign-ups are automatically archived 14 days after the response deadline has passed and once a set expiry date has been reached. Archived content can no longer be accessed via the shared links; the creator can still view, reactivate or delete it in their account.
9.2. If an account is not confirmed within 48 hours after a poll or sign-up has been created, the started account and the associated content are deleted automatically and without further notice. Existing Pro subscriptions are not affected by this.
9.3. The user can delete their polls, sign-ups and participant data themselves at any time. When the account is deleted, all associated content, including the responses of participants, is removed.
9.4. Further information on the processing and storage of personal data can be found in the privacy policy.
10.1. The operator strives for a high availability of the Platform but cannot guarantee uninterrupted availability.
10.2. Maintenance work is announced where possible.
10.3. The Platform is provided "as is". The operator gives no warranty as to its fitness for a particular purpose.
11.1. The operator is only liable for damage caused intentionally or through gross negligence.
11.2. Liability for indirect damage, loss of profit or loss of data is excluded to the extent permitted by law.
11.3. Liability is in any case limited to the amounts paid by the user in the last 12 months.
11.4. The user is responsible for regularly backing up their data.
The protection of personal data is important to us. Details on data processing can be found in our privacy policy.
13.1. All rights to the Platform, in particular copyrights, trademark rights and other intellectual property rights, remain with the operator.
13.2. The user receives a non-exclusive, non-transferable right to use the Platform in accordance with these GTC.
14.1. The operator reserves the right to change these GTC at any time.
14.2. Material changes will be communicated to registered users by email.
14.3. Continued use of the Platform after the changes have come into force is deemed to constitute acceptance of the new GTC.
15.1. Swiss law applies exclusively, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
15.2. The place of jurisdiction is Aadorf, Switzerland. Mandatory statutory places of jurisdiction are reserved.
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
